Canal Toys USA Ltd. “12 Days of Giveaways” Official Rules

The Advent Giveaway (the “Giveaway”) is sponsored and administered by Canal Toys USA Ltd, 1700 West Park Drive, Westborough, Massachusetts, 01581 (the “Sponsor”). This Giveaway is in no way affiliated, sponsored by, endorsed by, or associated with Instagram and its respective shareholders, affiliates, or subsidiaries.
By submitting an entry, you represent and warrant that you meet the eligibility requirements stated in these Official Rules and agree to be bound by these rules and any other requirements designated by the Sponsor, which are final in all respects.
- ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia that are at least 18 years or older at the time of entry.
Employees of Canal Toys, immediate family members of employees, and individuals living in the same household of said employees are ineligible to enter. VOID IN PUERTO RICO, U.S. TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED OR RESTRICTED BY LAW and subject to all federal, state, and local laws.
- Entry Periods: There will be one (1) giveaway occurring every day from December 13, 2022 through December 24, 2022. Each giveaway is open from the time of posting through 11:59 PM on December 24, 2022 (“Giveaway Period”).
- How To Enter: You must have an Instagram account to enter. During the Giveaway Period, Sponsor will post about each giveaway one (1) time on its official Instagram account (@canaltoysglobal). To enter any of the respective giveaways within the Giveaway Period, entrants must like the giveaway post, follow or be following @canaltoysglobal on Instagram, and tag three (3) other Instagram users in a comment. Limit is one (1) entry per person per day. Sponsor will not be responsible for lost, late, incomplete, or misdirected entries due to any reason. Additional entries in the same day will not be counted and will not increase chances of winning. Use of multiple Instagram accounts by the same individual to enter is prohibited. No purchase necessary to win. Purchase will not increase chances of winning.
- Selection of Winner, Winner Notification, CLAIMING PRIZE: There will be a total of 24 winners (2 winners per giveaway). All Potential Winners will be selected at random from among all eligible entries at the discretion of Sponsor. The Winners will be notified via either direct message or a comment on the Giveaway post using the winner’s Instagram handle that was used for entry. All decisions made by Sponsor relating to Giveaway are final. Winners will only be selected if he/she has complied with the Official Rules. Once a Winner has been selected and contacted by the Sponsor, it is the Winner’s sole responsibility to provide Sponsor with an address to send the prize to. If Sponsor does not receive this information within 2 business days of being contacted, it is understood that the right to claim the prize is forfeited and Sponsor will choose another Winner from the remaining eligible entries. If the winner is not reachable at the provided Instagram handle or if notification is returned as undeliverable, the prize will be forfeited, and an alternate potential winner may be selected at the Sponsor’s discretion. Winner may be required to provide proof of identification. The odds of winning depend on the number of eligible entries. In the event of a dispute as to the identity of a Winner based on their social media handle, Sponsor will determine the actual Winner to be the individual which was the authorized account holder at the time of entry submission. By accepting the prize, the Winner consents to Sponsor’s use of their name and social media handle in any and all media developed for all business purposes known now or hereafter without additional compensation or permission unless prohibited by law.
- Prize: Prize will be one (1) product per winner. Prize is as stated in each giveaway post. Prize is nontransferable and cannot be redeemed for cash. Sponsor makes no representation or guarantee concerning the appearance or performance of any prizes awarded. In the event that the aforementioned prizes are unavailable at the time of fulfillment, replacement prizes of the same value will be issued. All applicable federal, state, and local taxes are the responsibility of each winner. Sponsor is not responsible for lost or stolen prizes, nor for unavailability due to circumstances beyond Sponsor’s control.
- Liability Release: To the fullest extent permitted by law, Entrants agree to forever and irrevocably release, discharge, indemnify, and hold Sponsor and Instagram, and each of their respective directors, officers, employees, parent companies, affiliates, subsidiaries, divisions, agencies and all prize suppliers, harmless from any and all liability, losses, damages, rights, claims, and actions of any kind in connection with the Giveaway, or as a result of acceptance, possession, use or misuse of prize including any activity relating to personal injuries, death, or property damage. By entering the Giveaway, entrants agree to abide by and accept Sponsor’s decisions and waives any right to appeal.
- Privacy: Sponsor will collect, process, and use personal information provided by entrants for the sole purpose of the random drawing of this Giveaway, its Winner Notification, and its Winner announcements.
- Right to Modify or Cancel: Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes.
- General: By entering the contest, Entrants agree to abide by and accept these Official Rules and the decisions of the Sponsor, which are final in all respects. Entrants waive the right to claim ambiguity in these Official Rules. Sponsor assumes no responsibility to any technical, typographical, mechanical, human, or other errors, that may affect this Giveaway.
- Governing Law:By entering the Sweepstakes, Entrant acknowledges and agrees that these Official Rules, the Sweepstakes, and all disputes related thereto are governed by the laws of the State of Massachusetts in United States, without regard to its conflict of laws principles.
